The following are the terms and conditions for use of the Riot Fest Foundation website operated by Riot Fest Foundation (collectively, “RFF”) in support of the RFF mission (the “Site”). These Terms of Use apply to the RFF Site and the delivery of news, content, and services provided by RFF (the “Content”), and the collection of data by RFF.
The Sites and Content are offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the Site constitutes your agreement to all such terms, conditions, and notices. Your participation in a volunteer opportunity or grant opportunity (“Opportunity(ies)”) may also be subject to additional terms, codes of conduct, or guidelines that govern such events and grants.
RFF reserves the right to change the terms, conditions, and notices under which the Site and Opportunities are offered. You are responsible for regularly reviewing these terms and conditions. Your continued use of the Site or participation in an Opportunity constitutes your agreement to all such terms, conditions, and notices.
PERSONAL AND NON-COMMERCIAL USE LIMITATION; INTELLECTUAL PROPERTY RIGHTS
The Content made available through the Site is the property of RFF or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not modify, copy, upload, download, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Site without the express consent of RFF. You acknowledge that RFF retains exclusive ownership (or is the licensee) of the Site, all Content contained therein, and all intellectual property rights associated therewith. Except as expressly provided herein, you are not granted any rights or license to patents, copyrights, trademarks, or trade secrets with respect to the Site or the Content, and RFF reserves all rights not expressly granted hereunder. Without the advance express written permission of an authorized representative of RFF, you may not “meta-search” the Site, send, or cause to be sent, any automated queries of any sort to the Site, or use the Site in any commercial manner.
LINKS TO THIRD-PARTY SITES
The Site may contain links to third-party Web Sites (“Linked Sites”). The Linked Sites are not under the control of RFF, and RFF is not responsible for the contents of any Linked Site except to the extent expressly set forth herein. You are responsible for viewing and abiding by the privacy policies and terms of use posted at the Linked Sites.
NO UNLAWFUL OR PROHIBITED USE
As a condition of your use of the Site, you will not use the Site for any purpose that is unlawful or prohibited by these terms, conditions, and notices or causes damage to any third-party. You may not use the Site in any manner that could damage, disable, overburden, or impair any Site (or the network(s) connected to any Site) or interfere with any other party’s use and enjoyment of any Site. You may not attempt to gain unauthorized access to any Site, any accounts, computer systems, or networks connected to any Site, through hacking, password mining, or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Site.
INDEMNIFICATION
You hereby agree to indemnify and hold RFF and its directors, officers, employees, agents and affiliated parties (“Rff Parties”) harmless from all claims, liabilities, damages, and expenses (including attorneys’ fees and expenses) (each a “Claim”) arising out of or relating to: (A) your use of the Site; (B) your participation in an Opportunity; or (B) any alleged breach of this Agreement by you.

THE CONTENT INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY MADE TO THE SITE AND TO THE INFORMATION THEREIN. RFF MAY MAKE MODIFICATIONS, IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME. RFF MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, LACK OF VIRUSES OR OTHER HARMFUL COMPONENTS AND ACCURACY OF THE INFORMATION, CONTENT, OR RELATED GRAPHICS CONTAINED WITHIN THE SITE. YOU SPECIFICALLY AGREE THAT THE RFF PARTIES ARE NOT RESPONSIBLE OR LIABLE FOR ANY THREATENING, DEFAMATORY, OBSCENE, OFFENSIVE, OR ILLEGAL CONTENT OR CONDUCT OF ANY OTHER PARTY OR ANY INFRINGEMENT OF ANOTHER’S RIGHTS, INCLUDING INTELLECTUAL PROPERTY RIGHTS OR DATA BREACH. THE RFF PARTIES LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE AND NOT PARTICIPATE IN AN OPPORTUNITY.
These terms, your use and access to the Site and participation in an Opportunity is governed by the laws of the State of Illinois. You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in Cook County, Illinois, U.S.A., in all disputes arising out of or relating to the use of the Site or participation in an Opportunity.
Consent
By accessing the Site, providing information directly through the Site, through a Third Party Site, or through offline means (for example by submitting a form to RFF), and accessing the Content or participating in an Opportunity, you accept and agree to this Privacy Policy and you consent to our collection, storage, use and disclosure of your personal information as described in this Privacy Policy. Each time you visit our Site and any time you voluntarily provide us with information, you agree that you are consenting to our collection, use and disclosure of the information that you provide, and you are consenting to receive emails, other targeted communications, or otherwise be contacted, as described in this Privacy Policy. Whether or not you register or create any kind of account with us, this Privacy Policy applies to all users of the Site and participants in Opportunities. In the event of a change to this Privacy Policy, we will update the “Last Modified” date and notify you on our homepage that the Privacy Policy has been recently updated. Your continued use of the Site or participation in an Opportunity after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates. Information We Collect
We may collect two categories of information from you, Personal Information and Non-Personal Information, each of which is described below.
Personal identification information
We may collect Personal Information from Users through the Site and through other means if you voluntarily submit such information related to an Opportunity. “Personal Information” includes information that can be used to personally identify you, such as name, email address, mailing address, phone number and, job title, and federal Employment ID Number. We may collect Personal Information in a variety of ways, including, but not limited to, when Users visit our Site, register on the Site, subscribe to the newsletter, submit forms, voluntarily provide and submit information in free-form fields, and in connection with other activities, services, features or resources we make available on our Site, volunteer or apply for, or otherwise participate in an Opportunity. Users may be asked for, as appropriate, name, email address, mailing address, phone number, and credit card information. While we may collect Personal Information from you, we may also authorize our third party integrated sites (“Integrated Sites”) to collect Personal Information from you with your consent. For example, if you make a donation for one of our causes, you may be asked for payment information as part of the transaction. That information may or may not be shared and/or stored by us. You are encouraged to review the privacy practices of any Integrated Site.
Users may, however, visit our Site without submitting any Personal Information. We will collect personal identification information from Users only if they voluntarily submit such information to us. Personal Information that we collect depends on how you use the Site. For example, if you make a donation through our Site, we may collect additional information like billing address and financial information like credit card number, expiration date, security code and other billing information to permit us to process payments for donations you make through the Site. Providing your Personal Information to us is your choice. If you choose not to provide us with certain Personal Information, you may not be able to take advantage of certain features of the Site.
Non-personal identification information
We may collect non-personal identification information about Users whenever they interact with our Site, an Integrated Site, register for an Opportunity, make a donation, or otherwise engage with Riot Fest Foundation or the Site. Non-personal identification information includes information that cannot be used by us to personally identify you, even if it may specifically be about you, such as anonymous usage data, general demographic information, ISP utilized to access our Site, referring/exit pages and URLs, platform types, preferences you may submit to us and preferences that are generated based on the data you submit, number of clicks, and similar technical information, your social and donation habits. We automatically receive information about your interactions with our Site, such as the pages or other content you view, the products you search for or purchase, and the dates and times of your visits, to help us understand how you use our Site, help us improve our Site, and provide you information about our Site. We also use this information for analytics purposes. This Privacy Policy does not limit in any way our use, sharing, or disclosure of Non-Personal Information and we reserve the right to use and disclose such Non-Personal Information to our partners, advertisers, Integrated Sites, Third Party Sites (for example, sites providing automated marketing or website visitor analytics) and other third parties in our sole discretion.
Web browser cookies
As with many other websites, the web servers used to operate the Site may automatically collect certain data pertaining to you, including your location, computer operating system, Internet Protocol (IP) address, access times, browser type and language, and the website you visited before or after visiting our Site. For security reasons and to confirm the integrity of the Site, RFF, our Integrated Sites, third-party service providers, including third-party vendors, consultants, sales and ordering platforms, data warehouses and other service providers who work for us (our “Contractors”) may combine components of these data with personal information, which may identify you. Unless otherwise described in this Privacy Policy, such identifying information will be used solely for our business purposes. RFF and our Contractors may use this information to help administer the Site and the servers that provide the Site, generate statistical information, monitor and analyze traffic and usage patterns on the Site and improve the Site’s Content and Content delivery.
Our Site may use “cookies” to enhance User experience and collect Non-Personal Information. A cookie is a small text file which includes an anonymous unique identifier. Cookies are sent to a User’s web browser from our servers, which are then placed on their hard drive for record-keeping purposes and sometimes to track information about them. Sending a cookie to a User’s browser enables RFF to collect Non-Personal Information about a User and keep a record of the User’s preferences when utilizing our Site and Services, both on an individual and aggregate basis. RFF may use both persistent and session cookies. Persistent cookies remain on your computer or device after you close your session and until you delete them, while session cookies expire when you close your browser. Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. Please note that you may not be able to access the full functionality of our Site if cookies are disabled on your browser. We use cookies to see which areas and features of our Site are popular and to count visits to our Site. Our Site also makes use of web browser cookies and tracking pixels for our business purposes, for example to display ads across the Google display network, utilizing social network functionalities (for example, we may use tracking pixels on platforms such as TikTok, Twitter, Facebook, and others to provide a personalized user experience), remarketing, to display ads based on users search history and past browsing history of the Site. Users may opt out of Google’s use of cookies by visiting Google’s Ads Settings.
We may use web beacons (a.k.a. clear GIFs, web bugs or pixel tags) to personalize your experience of the Site and Services and to generate information about traffic and trends. Web beacons collect online information, such as the type of browser that you use and your IP address. Web beacons may be used alone or in conjunction with cookies; when web beacons are used with cookies, they may link online information to other Personal Information that you have provided to us. Web beacons usually are not visible to you.
Some content or applications, including advertisements, on the Site are served by third parties, including advertisers, ad networks and servers, content providers and application providers. These third parties may use cookies alone or in conjunction with web beacons, or other tracking technologies to collect information about you when you use our Site. The information they collect may be associated with your Personal Information (for example, if you interact with our Site through a social platform like TikTok, Twitter, or Facebook) or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.
“DO NOT TRACK”
Please note that we currently do not employ technology that recognizes “do-not-track” signals and do not accept them at this time.
How we use collected information
RFF may collect and use Users Personal Information and Non-Personal Information for the following purposes:
- To improve customer service: Information you provide helps us respond to your customer service requests and support needs more efficiently.
- To personalize user experiences: We may use information in the aggregate to understand how our Users as a group use the Site.
- To improve our Site: We may use feedback you provide to improve our website, products and services.
- To process payments: We may use the payment information Users provide about themselves when placing an order only to provide service to that order. We do not share this information with outside parties except to the extent necessary to provide the service.
- To run a promotion, contest, survey or other Site features.
- To send Users information they agreed to receive about topics we think will be of interest to them.
- To send periodic emails: We may use the email address to send you information and updates pertaining to your order, the Site, and to respond to inquiries, questions, and/or other requests Users submit to us. Generally, you may not opt-out of these communications, which are not promotional in nature. How we protect your information
We adopt reasonable and appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your Personal Information.
Sensitive and private data exchange between the Site and its Users happens over an SSL secured communication channel and is encrypted and protected with digital signatures.
However, you understand that, while we follow industry best practices to protect your Personal Information, we cannot guarantee that your information will not be accessed, disclosed, altered or destroyed due to a breach or actions of a third party. By using the Site, you acknowledge that you understand and agree to assume these risks.
Sharing your personal information
We do not sell, trade, or rent Users Personal Information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined in this Privacy Policy. We may decide from time to time to utilize a number of business and marketing partners and other Integrated Sites in delivering the Content. To donate through the Site, we may require credit or debit card account information. By submitting your credit or debit card account information through our Site, you expressly consent to the sharing of your information with Integrated Sites, third-party payment processors, and other third-party service providers. We share this information with our third-party payment service providers in order to process your payments. These third parties may also store your credit or debit card information, other than your CVV number, for your future use on our Site. Your CVV number will not be stored and must be re-entered for each order. Data collected by our third-party payment processors is subject to such third party’s own terms related to data privacy.
Third party websites
Other third parties (such as social media networks and payment processing platforms that you may use in connection with our Sites) may also use, collect and share information about you. We are not responsible for, and these terms does not apply to, the privacy practices of other companies or other websites or mobile applications. We encourage you to seek out and read the privacy policy of each website that you visit and each mobile application that you use including any which may be integrated with the Site to enable up to provided their functionality and optimal user experience to you. Users may find advertising or other content on our Site that link to the sites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from our Site. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own privacy policies and customer service policies. Browsing and interaction on any other website, including websites which have a link to our Site, is subject to that website’s own terms and policies.
Compliance with Children’s Online Privacy Protection Act
We do not knowingly collect any Personal Information from children under 13 without prior verifiable parental consent. If RFF learns that a child under the age of 13 has submitted Personal Information to us without parental consent, we will take all reasonable measures to delete the information as soon as possible and to not use such information for any purpose, except where necessary to protect the safety of the child or others as required or allowed by law. Rights of EU Residents
The Site is hosted and operated in the United States. However, RFF and our Contractors may, in our effort to provide the Site, store collected information in the United States, or we may transfer it to, and store it within, other countries.
Those who access or use the Site from jurisdictions outside the United States do so at their own choice and risk and are solely responsible for compliance with local law. If you are not a resident of the United States, you acknowledge and agree that we may collect and use your Personal Information outside your home jurisdiction, and that we may store your Personal Information in the United States or elsewhere. Please note that the level of legal protection provided in the United States or other non-European countries from which you may access our Site may not be as stringent as that under European Union privacy standards or the privacy laws of some other countries, possibly including your home jurisdiction. RFF has the discretion to update these terms at any time. When we do, we will revise the updated date on this page. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications. Consumer Rights
You have the right to request that we disclose to you (i) the categories of personal information we collected about you and the categories of sources from which we collected such information; (ii) the specific pieces of personal information we collected about you; (iii) the business or commercial purpose for collecting or selling personal information about you; and (iv) the categories of personal information about you that we sold or disclosed for a business purpose and the categories of third parties to whom we sold or to whom we disclosed for a business purpose such information in the preceding 12 months.
You have the right to request that we delete personal information we collected from you subject to certain exceptions.
You have the right to “opt-out” of your personal information being sold to certain third parties. This right can be exercised by submitting a Do Not Sell My Personal Information request.
You also have the right to not be discriminated against in pricing and services because you exercise any of your rights under the CCPA. LNRS does not offer financial incentives or price or service differences to consumers in exchange for the retention or sale of a consumer’s personal information.

You may be required to submit proof of your identity for these requests to be processed. Such information may include your First Name, Last Name, Street Address, City, Zip, and Date of Birth and either your Social Security Number or your Driver’s License Number and State. This information will be used only for the purposes of verifying your identity and processing your request. We may not be able to comply with your request if we are unable to confirm your identity or to connect the information you submit in your request with personal information in our possession. You may designate an authorized agent to make a request on your behalf subject to proof of identity and written authorization.
We will respond to your request consistent with the CCPA, which does not apply to certain information, such as information made available from government records, certain data subject to the Fair Credit Reporting Act (FCRA), Gramm-Leach-Bliley Act (GLBA) and certain other laws, and where its application is preempted by, or in conflict with, federal law or the United States or California Constitution.
